Terms Of Service


These Terms of Service (TOS) govern the relationship between HOSTGEE ('Hostgee'), registered in Saudi Arabia, and you and your heirs, assigns, agents and contractors (collectively, 'Customer') and is effective as of the date of electronic, verbal or written execution. By subscribing to any of the services ('Services') with Hostgee Customer agrees to be bound by these terms and conditions.

Term of a Contract

Unless stated otherwise, the contract is made for a minimum term of 1 month. Unless a notification of termination is received before the expiration of the initial period, the contract is automatically renewed for another minimum term and so on. The contract comes into effect at the effective date agreed upon or at the date Customer starts using the Services, whichever comes first. Fixed-term agreements will terminate upon expiration of the period stated on the contract. The fixed-term contract can be renewed by extending the term of the contract.

Customer Responsibilities

A. Under no circumstances is the customer authorized to engage in any activity that is illegal under local, national or international laws while utilizing Hostgee Services. The list of banned content includes, but is not limited to:

  • Copyrighted material without the explicit permission of the copyright owner including video, audio, and text.
  • IRC - running any IRC software such as IRC client software, IRC server software, web-based IRC software and IRC bots.
  • Proxy/VPN - We prohibit any proxy/VPN set-ups or connections or any activity through remote proxy connections.
  • HYIP - We prohibit HYIP websites and websites involved in advertising or promotion of such resources.
  • Warez - Pirated or cracked versions of commercial software, hacking tools, emulators and guides to such activities.
  • Spyware / Malware / Scareware - virus/spyware distribution via a dedicated server managed by Customer that may cause a security breach to others, will result in account termination.

For more information on banned material please visit our Acceptable Use Policy, it is an integral part of the Terms of Service document and by subscribing to any of Hostgee services you agree to comply.

B. Customer agrees to keep secure the all login information to Dedicated Server located at Hostgee facility. Sharing your Dedicated Server with an unauthorized third party is strictly prohibited. It is the responsibility of a Customer to prevent unauthorized access into the Customer's systems.

The Customer will inform Hostgee immediately of any problems or interruptions of services, equipment or software malfunctioning that the Customer has discovered while using the Service including illegal/potential illegal activities by unauthorized parties.

Customer is responsible for using the equipment leased by Hostgee with due care and deliberate misusage of the equipment may result in Customer's financial liability. It is Customer's sole responsibility to make regular back-ups of your data and files used in connection with the Services. Hostgee may make our periodic back-ups for server maintenance purposes. However, Soar is not responsible whatsoever for the loss of data or files.

Billing

The prices are stated in USD, SAR, and EUR for your convenience. You may make a payment in the currency indicated in your contract/agreed upon. The Service will be billed monthly unless otherwise agreed upon. The first invoice will include all initial costs, including installation costs (inapplicable).

Invoices are generated ten days before the due date. Payment must be made by the due date to avoid the suspension of your account. If no payment is received, the Service will be suspended five days after the due date with permanent termination of the account ten days later. 100 USD fee is charged to resume the Service, once it has been suspended.

Refunds

Hostgee does not provide refunds. All sales are final. We do not refund any part of our billing fees for any unused time except for servers terminated by Hostgee's decision.

DDoS Protection Terms

DDoS protection that is provided with Dedicated Servers and Cloud Hosting Servers applies to on-site equipment only and is not available for remote 3-rd party Servers that are not hosted with Hostgee. Hostgee does not provide a mitigation guarantee for a free DDoS protection plan that is supplied with Dedicated Servers and Cloud Servers. Customers are not allowed to proxy or tunnel IP traffic through DDoS protected Servers hosted within the Hostgee network. Violation of DDoS protection terms will result in service termination within 24-hour time frame.

If DDoS attack rate exceeds 10 Gb/s or 4 Mpps, attacked IP address will be null-routed for 24 hours. If a massive DDoS attack that exceeds protection capacity occurs again or if it can seriously affect Hostgee's network, we reserve the right to terminate your server(s). In this case, you will receive a refund for the unused service time.

Colocation

Hostgee provides Colocation hosting for equipment that occupies up to 4U space. Equipment without rack mounts will not be accepted. It is a sole customer responsibility to provide all necessary rack mounts.

Liability

Hostgee will not be liable for failure or delay in performing its Services if such failure or delay is due to circumstances beyond its reasonable control, such as acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, equipment malfunctioning, unavailability of, interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies or power used in or equipment needed for provision of the Services.

Hostgee will not be liable for damage or interruption of service caused third parties such as dos-attacks, hacking or malware. Customer may be held liable for damages caused to Hostgee or to third parties as a result of the Customer's usage of the Service.

Termination

Hostgee reserves the right to refuse, terminate, or suspend the Services being provided to Client at our sole discretion without prior notification if Hostgee reasonably deem Client a threat to the integrity of our network as a result of your actions or threats to take such steps, Client is found in breach of this TOS or AUP, complaints received regarding activities of the Client from third parties, non-payment of outstanding invoice.

Client can terminate the Contract any time before automatic renewal of the contract. The contract will be void upon expiration of the initial (minimal) term and will not be renewed if the termination notice was received. The fixed-term contract is considered expired after the final date of the agreement and cannot be terminated before that date.

It is the responsibility of the Client not to overpay the invoices Hostgee provides to Client, as in the event of early cancellation or overpayment, the refund will not be provided.

Governing Law

This Agreement will be governed by and construed and interpreted under the law of Saudi Arabia, and the parties submit to the exclusive jurisdiction of the Saudi Courts.

Amendments

Hostgee reserves the right to modify this Terms of Service at any time, without prior notice. We will take reasonable effort to notify the Client regarding such changes.
